GDPR Compliance

ArkBotLabs, a brand under ArkDevLabs, is committed to protecting the privacy and personal data of all users, including those located within the European Economic Area (EEA) and the United Kingdom. This page explains our obligations and your rights under the General Data Protection Regulation (GDPR) (EU) 2016/679 and applicable national implementing legislation.

This page should be read alongside our Privacy Policy, which provides full details of the data we collect, how it is used, and how long it is retained.

1. Data Controller

For the purposes of the GDPR, ArkDevLabs acts as the data controller in respect of personal data processed through ArkBotLabs products and services. As data controller, we determine the purposes and means of processing personal data collected through our Discord bots, automation tools, moderation systems, logging services, and associated websites.

Where third-party infrastructure providers process data on our behalf (such as hosting or database services), they act as data processors under appropriate data processing agreements, and are not permitted to use your data for their own purposes.

2. Personal Data We Process

The categories of personal data we may process when you use our Services include:

  • Discord User IDs — unique numerical identifiers linked to individual Discord accounts.
  • Discord Server (Guild) IDs — identifiers for servers where our products are active.
  • Channel IDs and Role IDs — used to deliver product functionality within your server.
  • Configuration settings — preferences and rules set by server administrators.
  • Command usage data — records of interactions with our bots, including timestamps and server context.
  • Diagnostic and aggregated usage information — used to maintain and improve our Services.

We do not process special categories of personal data (such as health, biometric, or political data) and do not intentionally process the content of private messages or voice communications.

3. Lawful Bases for Processing

Under the GDPR, we are required to identify a lawful basis for each processing activity. ArkBotLabs relies on the following lawful bases:

  • Contract performance (Article 6(1)(b)) — Processing that is necessary to deliver the Services you have requested, such as storing server configuration data and executing bot commands.
  • Legitimate interests (Article 6(1)(f)) — Processing necessary for our legitimate interests in maintaining service security, diagnosing performance issues, preventing abuse, and improving our products, provided these interests are not overridden by your rights and freedoms.
  • Legal obligation (Article 6(1)(c)) — Processing required to comply with applicable law, which may occasionally require retention of certain records.

We do not rely on consent as a lawful basis for routine data processing. Where consent is required for any specific feature or communication, it will be sought separately and clearly.

4. Your GDPR Rights

If you are located within the EEA or UK, you have the following rights in relation to personal data we hold about you:

  • Right of Access (Article 15) — You may request a copy of the personal data we hold about you and information about how it is processed.
  • Right to Rectification (Article 16) — You may request correction of inaccurate or incomplete personal data.
  • Right to Erasure (Article 17) — You may request deletion of your personal data where it is no longer necessary for the purposes for which it was collected, or where you have withdrawn consent and no other lawful basis applies.
  • Right to Restrict Processing (Article 18) — You may request that we limit how we use your data in certain circumstances, such as while a rectification request is being resolved.
  • Right to Data Portability (Article 20) — Where technically feasible and where processing is based on contract or consent, you may request a structured, machine-readable copy of your personal data.
  • Right to Object (Article 21) — You may object to processing carried out on the basis of legitimate interests. We will cease processing unless we can demonstrate compelling legitimate grounds that override your interests.
  • Rights related to automated decision-making (Article 22) — We do not carry out solely automated decision-making that produces legal or similarly significant effects on individuals.

To exercise any of these rights, please contact us using the details in Section 8 below. We will respond to verified requests within 30 days. In complex or high-volume cases, this period may be extended by a further two months, in which case we will notify you of the extension and the reason.

5. Data Retention

We retain personal data only for as long as is necessary to fulfil the purpose for which it was collected, or as required by law. Full retention periods for each data category are set out in our Privacy Policy. In summary:

  • Server configuration data is deleted within 30 days of a bot being removed from a server.
  • Command usage and diagnostic data is retained on a rolling 90-day basis, after which it is purged or fully anonymised.
  • Moderation log data may be retained longer where required for audit purposes, subject to server administrator configuration.

You may request earlier deletion of your data at any time by contacting us. Requests will be fulfilled unless retention is required for legal, security, or legitimate operational reasons, in which case we will explain the basis for continued retention.

6. International Data Transfers

Our Services operate through infrastructure that may be located outside the EEA. Where personal data is transferred to countries that do not provide an equivalent level of data protection, we ensure appropriate safeguards are in place in accordance with GDPR Chapter V. These safeguards may include standard contractual clauses approved by the European Commission, or reliance on adequacy decisions where applicable.

Your use of Discord also involves data transfers governed by Discord's own privacy framework, which is independent of ours.

7. Supervisory Authority

If you are located within the EEA or UK and believe that our processing of your personal data infringes the GDPR, you have the right to lodge a complaint with the supervisory authority in your country of residence or place of work. A list of EEA supervisory authorities is available at edpb.europa.eu. UK users may contact the Information Commissioner's Office (ICO) at ico.org.uk.

We encourage you to contact us directly in the first instance, as we will make every reasonable effort to resolve your concern promptly.
